Crypto Swap Tax FAQ
Wait, I didn't get any USD - why is this taxable?
IRS treats it as: sell BTC for USD → buy ETH with that USD. Two transactions in one. The "sell" part triggers tax.
What about like-kind exchange (1031)?
Doesn't apply to crypto anymore. The 2017 tax law explicitly limited 1031 to real estate. Crypto swaps are taxable.
I swapped on a DEX - is it tracked?
The blockchain records everything. Exchanges report to IRS. Tax authorities are getting better at on-chain analysis.
How do I find the FMV at swap time?
Use the exchange rate at the moment of swap. DEX: check the transaction. CEX: check your trade history. CoinGecko has historical prices.
Multiple swaps in a chain - how to track?
Each swap is separate. BTC→ETH→SOL = 2 taxable events. Your new basis carries forward each time.
Can I use losses from bad swaps?
Yes! Swap your losers to harvest losses. Use them to offset gains. No wash sale rule (yet) means you can rebuy immediately.
What about NFT purchases with ETH?
Same thing - disposing of ETH is taxable. You're "selling" ETH to buy the NFT. Calculate gain/loss on the ETH.
Gas fees - can I include them?
Yes, gas adds to your cost basis for the new asset. Reduces your gain when you eventually sell. Keep records!
Swapping between stablecoins?
Technically taxable, but usually no gain/loss since both are ~$1. Still report it. Some ignore due to minimal impact.
